this morning. the cause is still under investigation. that's what's happening today on the bay. we're back at 7:25 with another local news update. good morning, raging, out of control wildfires burning in nearly a dozen states right now including the massive blaze in idaho threatening the town of sun valley. we're live near the front lines. breaking overnight, blade runner oscar pistorius wipes ay tears as he's indicted on a charge of premeditated murder of his girlfriend as prosecutors unveil more evidence against him. >> and alex rodriguez hit by a pitch in boston drawing cheers from the crowd but he comes back later with a crucial home run all part of the dramatic and controversial weekend for the yankees slugger. his attorney joins us exclusively today, monday,

early september. we'll get back in there but right now it's fan appreciation week on the plaza. >> that's right. we have a lot of news about fan appreciation week. but in the meantime we have a lot of news to get to and we'll start with the fires out west. that's right. firefighters are being stretched thin out west. dozens of wildfires are burning right now. the biggest and probably most dangerous the so-called beaver creek fire. it's creeping closer to thousands of homes in idaho. miguel almaguer is in hailey. miguel, good morning to you. >> reporter: good morning, matt. firefighters are rotating in and out of this fire camp 24 hours a day. resources from all across the country pouring in right here but despite the massive and rapid response they have not been able to contain this blaze. >> reporter: swallowing forest lands, slicing across ridge tops overnight. the nation's most dangerous fire is a blow torch, closing in on 5100 homes. >> it's scary to look out your window and see the flames coming down the hill.

>> reporter: raging out of control for a 12th day, the beaver creek fire has decimated 150,000 square miles, more than seven times the size of manhattan. more firefighters are on the way. hot shot crews are working to build containment lines trying to pin down a stubborn blaze still on the move. 30-mile-per-hour gusts can carry hot embers for miles igniting new fires impossible to outrun for crews on the front lines. >> winds really push the fire in one direction or another. that's extremely hazardous for firefighters on the ground. >> reporter: the air attack in idaho is critical. recardant drops over homes, another layer of protections. properties here cost millions. arnold schwarzenegger, tom

hanks, and bruce willis among the rich and famous with homes under threat. fires are scorching the west. 35 uncontained infernos from oregon to california, across 11 states to colorado are burning today. though this fire is threatening billions of dollars in property, incredibly only one home here has been lost. there is some good news, this fire is 8% contained. savannah? all right. miguel almaguer in idaho for this. thank you. meantime, breaking news in the oscar pistorius case. the sprinter appearing in a south african court this morning formally charged in the murder of his girlfriend. ron is outside the courthouse with the story. good morning to you. >> reporter: good morning, savannah. yes, this morning prosecutors say oscar pistorius intentionally shot and killed reeva steenkamp. he admits that he shot and killed her, but he says he was firing as an intruder he thought in his home that night. prosecutors think this is not a case that involves a mistake.

they say it's a case of murder. olympic sprinter oscar pistorius arrived in court appearing somber and focused. his head was bowed through much of the proceeding. his family and friend there is to see him. not making eye contact with steenkamp's friends. everyone was dressed in black. in the indictment, prosecutors say state witnesses heard a woman scream followed by a gunshot and then more screaming. steenkamp died in the bathroom of pistorius's house, shot through a locked door. the indictment also says the accused shot with the direct intention to kill a person. >> the charges are premeditated murder. that means it was committed intentionally. it was planned. >> reporter: these pictures show steenkamp arriving at pistorius's gated home the night before she died. pistorius said they were alone and asleep until the early morning hours when pistorius

says he believed an intruder entered his house. >> i heard a noise in the bathroom and realized someone was in the bathroom. i felt a sense of terror rushing over me. without his prosthetic legs on and limited mobility he grabbed a 9 millimeter pistol and made his way to the bathroom. i fired shots at the toilet door and shouted to reeva to phone police. only after returning to the bedroom did he realize steenkamp was not there. since being released on bail a week after the killing, pistorius rarely has been seen in public. if pistorius is found guilty of premeditated murder the celebrity sprinter and golden boy of the london olympics could face 25 years to life in prison. the judge set the trial date for march 3rd of next year. there's also local media reports here that pistorius might be charged in two other cases of recklessly firing his gun in public. but today prosecutors are focused solely on the murder of reeva steenkamp. >> all right.

ron allen, thank you. let's turn to lisa bloom, today's legal analyst. >> good morning. >> this is the formal charge now. we saw a bit more of the prosecutions evidence. do you think this is a strong case for premeditated murder? >> well, i think it's a challenging case but i'm intrigued by this new allegation that there was a woman screaming before the shots were fired. if that's so, it's difficult to understand how oscar pistorius could have thought it was an intruder in the bathroom and his not his girlfriend. >> well, pistorius provided a written account and narrative of what he said happened that night. he did that as part of the bail hearing. is that a disadvantage to him now? he is more or less wed to that version of defense? >> the defense lawyers never like it when their client gives a detailed account of what happened. that's a blueprint from the prosecution to go through line by line and try to show inconsistencies and outright lies. i think one of the biggest issues in the case is going to

be the ballistic evidence. were they fired low and upwards which would support oscar's story that he wasn't wearing his prosthetic legs at the time or at a higher height and straight through the door which would show he had time to put the prosthetic legs on. >> it's an interesting point, it was demonstrate which version of the events is likely to be true. he apparently intends to argue because of his disability and unique circumstances he felt more fear about an intruder than another person might reasonably fear. is that a plausible argument? >> well, it's something that might help him. a lot of south africans are concerned about crime so that might make sense in that community. but it's hard to understand how if he felt fear, he wouldn't have first looked to his side to see if his girlfriend is there in bed. you that naturally protective instinct to protect his girlfriend before running to the bathroom. also intruders don't usually stop to use the bathroom so it's hard to understand how he would have thought a burglar was in

his restroom. >> and in south africa they don't have a jury trial. it's a bench trial. the judge will decide. is that a disadvantage to pistorius? >> could be. there will be less emotion in this case and more focus on the forensic evidence, on the cell phones, on what the witnesses have to say. as you say, savannah, ultimately, most importantly the story that he gave. is it consistent with all the other evidence in the case? >> lisa bloom, always great to get your perspective. thank you very much. >> natalie is here now. she has new developments on the on going violence in egypt. good morning to you. good morning. that's right, there is more turmoil in egypt after islamic militants ambushed two buses killing off duty policemen killing 25 of them. richard engle joins us in cairo with more. richard, good morning. >> reporter: good morning, natalie. disturbing incidents happening here. first the one you mentioned in the sinai peninsula this morning. two those minivans full of unarmed police officers were

stopped by militants. the militants forced the police officers to get out of the vehicle and then executed 25 of them and overnight 36 prisoners were killed allegedly while trying to escape. they were in the back of a truck. police fired tier gas into the truck and the prisoners died by suffocation. their families are saying it was a massacre carried out by police. it may have started as a military crackdown, but egypt now appears to be descending into an insurgecy with both sides armed and taking causalities. islamic extremists joined the fight backing the muslim brotherhood and attacking egyptian security forces. around 200 police have been killed in egypt since last week. so have some 900 supporters of the muslim brotherhood. many of them shot unarmed while protesting against the military

for ousting egypt's president. the man that did that, the military leader gave a national televised address overnight defending what some call a coup saying it was necessary to stop terrorism. the general insists the vast majority of egyptians are with him and he doesn't want to govern the country for long. the obama administration is weighing it's response. the state department putting a hold on economic aid to the government. but no change yet to critical military aid, though that could come. >> there's other strategic issues here including the safety and stability of israel. >> the u.s. faces a tough choice. stick with its long-time ali, which claims it needs support now more than ever to fight terrorism, or back away. while washington appears to be

wavering, saudi arabia, kuwait, the ua and jordon have all come out strongly in support of egypt's military. richard engle, thanks so much. a team from the united nations is in syria's capitol this morning to investigate the use of chemical weapons. they accused each other of using chemical weapons while denying it themselves. the u.n. team is expected to be there for about two weeks. the first family is back in washington this morning after a nine-day vacation on martha's vineyard. they arrived back at the white house late last night. the president spent most of his vacation out of private view. today he'll hold a private meeting with private vesters to discuss efforts on strengthening the nation's economy. more fallout on the edward snowden nsa leaks case. they detained the partner of the reporter that first revealed the leaks. david miranda was held under schedule 7 of the terrorism act which allows security agencies

to stop and question people at boarders. he was released after nine hours of questioning and was not arrested. now to wall street and what is moving the markets on this monday morning. jackie joins us. good morning. >> gas prices, aaa says they are down a penny from last week, but 14 cents from a month ago. the national average for a gallon of regular, now $3.53. one research firm saying internet traffic around the world dropped 40% when google experienced a brief outing on friday evening, and the will the dow rebound from the worst week of the year? or was last week's drop a sign of more pressure to come? wall street is watching, natalie. we'll be watching. thank you so much. more proof this morning that being a reporter can be a dangerous job even if it's covering a sporting event. this was last night at a new york giants, indianapolis colts preseason game, pam oliver was getting ready for an interview there when you saw she got drilled with a football right in

>> surrounding the death of princess diana. >> reporter: according to reliable british news outlets like channel 4 this was sparked by a former special forces soldier, or rather his estranged in-laws that wrote a letter complaining about his erratic behavior and threats. they claimed they threatened their lives, intimidated their daughter and told her diana's death was arranged by army special forces and then covered up. now generating disbelief and disgust among many who knew diana. >> there's no evidence and if princess diana had been wearing her seat belt she would have lived. so how can this be an assassination? the reality is that princess diana wasn't murdered. she was driven by a drunk driver at high speed being chased by the paparazzi. >> reporter: at the same time, a book is due out making similar claims to those alleged by the soldier. a movie out next month starting

wondering how if doping scandal was going to effect play on the field well they got a good taste of that last night. alex rodriguez was hit by a pitch. they said it looked deliberate and the umpire agreed with a warning to both teams. red sox fans don't have a lot of love for the yankees. they showed even less for alex rodriguez last night. nearly pegged on the first pitch and then nailed on the 4th. cheers from the crowd warnings for both teams and a serious yankees manager tossed from the game. >> we have one player hitting another player. >> right. >> because of what that other player is alleged to have done. >> yeah. >> third at-bat was a home run he faces the longest doping suspension in history, 211 games

for taking performance enhancing drugs and then trying to cover it up. so far, rodriguez has not publicly addressed major league baseball's charges. >> when i have the right forum at the right time, which is not now, i will tell my story. >> reporter: off the field one of his lawyers is making new allegations the high profile defense attorney tells nbc news that major league baseball's investigation into performance enhancing drugs was full of misconduct including going into a gated community and threatening to turn uncooperative witnesses over to the press or the police. he also accused the yankees organization of deliberately with holding information about a-rod's hip injury in 2012 in an attempt to end his career early and collect insurance on what's left of the third baseman's 10 year, 2$270 million contract.

they're challenging him to release his medical records. the yankees team president randy levine says alex should put up or shut up. the vice president had harsh words for tacopina saying first of all, major league baseball was not involved in any wrong doing and on top of that question whether tacopina had the credibility or standing to make the charges in the first place. matt. all right. stephanie, thank you very much. joe tacopina, one of alex rodriguez's attorneys is with us exclusively. good morning, nice to see you. >> good morning. >> do you have the credibility to make these claims. >> well, you know, i think so and if the vice president of major league baseball would be good enough to wave the clause i love nothing more than to talk about his history and various things. >> they sent us a letter

overnight saying they are ready to do exactly that. they said if you will sign this letter they're willing to waive the clause and they'll be allowed to talk about everything and you'll be allowed to talk about everything and that would include all prior violations committed by rodriguez, all documents, records, communications and text messages and instant messages related by rodrigu rodriguez. >> we have been asking for that for three or four weeks. they would love to not be -- >> if you'll sign it -- >> if you would like me to sit and read this i'll do it right now. >> they just sent this over to me. >> we would love nothing more than to be able to discuss the testing history and scientific evidence and testing of alex rodriguez involving this. nothing more. >> you made allegations on

behalf of alex rodriguez against the yankees and major league baseball about their ethics. when it comes down to it this began with major league baseball questions the ethics of alex rodriguez and alex has yet to answer the most important and most basic question in this, whether he once again used performance enhancing drugs. are you prepared to answer this question this morning. >> yes. alex admitted back in 2001 and 2002 that he had used performance enhancing drugs as a member of the texas rangers when it was not banned. he says since then he has not. i'll tell you this. this letter is nice. they could have sent it last night and i could have been prepared. i have so many things i would love to say. >> but doesn't he owe people an answer to that question before you start pointing fingers at people in other directions. >> no, listen matt, let me say this to you first, the reason we're sitting here today. we had this scheduled last week

and we cancelled -- alex was on the field and playing well, we didn't want to try this case, so to speak, in the media, but what's going on is outrageous. it's anonymous leaks and it has to stop. they're perverting the process. we want to do this in the right tribunal, i'll tell you this alex rodriguez will have been found not responsible to the point where he shouldn't serve one inning of a suspension. i know the evidence. >> and that's a question that puzzles people. you have 13 other players who were confronted with the exact same evidence. they all basically said give me the 50 game suspension, got me. alex rodriguez according to -- if we were to believe you looks at that evidence and says not me. i'm not a part of this. i did nothing wrong, why. >> that's not the exact same evidence. i know the evidence against alex rodriguez. it will never stand up in a

court of law or arbitration panel courtroom. the evidence was based on anthony bosch who the mlb made a deal with and offered to pay his legal fees to and not sue. >> you said he has no credibility. >> it's clear he has no credibility and more importantly he has no ability to testify because he is someone who has peddled drug to high school students. >> and you know released last night by espn and by bosch's attorney that say he retained the legal services in february 2013. a retainer was paid via wire transfer by a representative of alex rodriguez. she accepted this payment on behalf of anthony bosch as payment for his legal representation. if this guy has no credibility why would alex rodriguez contribute to his legal defense fund. >> there's another question that because of this clause, i'm not

another family. >> i would stare at the stars in the sky. >> reporter: he looked down on the streets of skid row. for four years james and his family were homeless. >> it was a very different situation. i wasn't prepared for it. >> reporter: when he wasn't in the shelter, there were nights with no place to go. >> i would try to hide it from people but now as i have gotten older i realized that i shouldn't have been embarrassed to begin with. >> reporter: avoiding to pitfall of the streets he found the shelter because of his mother. >> i was down on my luck and i fell to her and she picked me right back up. >> reporter: james excelled in high school. it was his ticket out of this place. with with grants, loans and scholarships, 70% of his expenses to howard university were covered but he was still short $14,000. >> he's not looking for a handout. he's just looking for a chance. >> reporter: at the union rescue

mission he met volunteer jessica sutherland. she had been homeless and when she learned james couldn't afford to go to college, she decided to help. >> james is an amazing kid that has persevered and excelled through some of the hardest circumstances you can think of. and despite it all, he only sees the positive of it. >> reporter: jessica launched the james find. a website that asks strangers for donations. after a tweet from teach for america and a few plugs from celebrities, in just seven days, jessica hit her goal. james could afford howard this year. >> i didn't know what to feel. i didn't believe it. it felt too surreal. it was like a dream. >> reporter: darren leach is one of his mentors. >> he's going to do phenomenal things. anything he puts his mind to he'll dominate. >> with enough to pay for his freshman year he needs to raise money to graduate.

stop for you. >> sara made her way to the birds of prey. >> meet bird of prey. it's a wonderful place that hosts baby birds but more import la antly, a rehab center that gets these birds back in the air. vultures circling overhead are a clear sign that you are at the center for birds of prey. here, hawks and other large birds are trained to show off their awe-inspiring flight. the training starts early. >> i did not like being in that box. >> this barn owl still sports his baby down feathers. >> you said you don't name them? >> no. a name to most would constitute an animal being a pet. and we have to be very careful that people don't associate wis cute, young animal that is hanging out around people, behaving like a pet animal might. >> this little guy may not get a name but he already has a zoo in colorado waiting to host him.
